About these terms

These terms apply when you buy, download or use a digital product from the MayneAI Shopify store. MayneAI is operated by Phillip Lindsay Mayne trading as Mayne & Sons (ABN 96 623 102 109), Brisbane, Queensland, Australia. By completing a purchase, you agree to these terms together with the product description, Return and refund policy and Privacy policy shown at checkout. If you buy for a business, you confirm that you have authority to make the purchase for that business.

The product

Each MayneAI Agent Pack is a collection of instructions, templates, onboarding material and examples for use in the supported AI platform named on the product page. The included agents produce drafts for you to review. They do not send messages, make bookings, access your inbox or calendar, change records, process payments or perform any other external action.

The product is the files and written material described on the product page. It does not include the third-party AI platform, bespoke setup, integrations, ongoing support, future updates or a guaranteed business outcome unless the product page expressly says otherwise.

Customer responsibility

AI output can be inaccurate, incomplete, unsuitable, outdated or unexpected. You control the information supplied to the AI platform and every decision to use, edit, rely on, publish or send an output. You must:

• provide accurate and lawful inputs;
• review every output for accuracy, suitability, tone, confidentiality and legal or regulatory requirements before using it;
• keep appropriate human approval over customer communications, records, quotes, invoices, schedules and decisions;
• maintain your own records, backups, security controls and required approvals; and
• use qualified professional advice where the subject requires it.

You remain responsible for your business decisions, communications, services, legal obligations and use of every output. MayneAI does not approve an output merely because the pack helped draft it.

No professional or high-risk reliance

The packs do not provide legal, financial, tax, medical, clinical, engineering, employment, emergency or safety advice. You must not use an output as the sole basis for a professional, regulated, safety-critical or high-impact decision. Where a pack is relevant to a regulated field, it is an administrative drafting aid only and does not replace review by an appropriately qualified person.

Acceptable use

You must not use a pack or its output to break the law, mislead or defraud a person, impersonate another person, infringe rights, disclose information you are not authorised to use, create harmful or discriminatory material, bypass security controls, or automate an action that requires human judgement or approval. You are responsible for ensuring that your use complies with the laws, professional rules, contracts and policies that apply to you.

Platform requirements and third-party services

Your purchase is for the platform named in the product title: ChatGPT, Claude or Microsoft Copilot. Access to that third-party platform is not included. You are responsible for maintaining any account or subscription the platform requires, using a compatible device and software, and following that platform's terms and policies.

MayneAI does not operate or control ChatGPT, Claude or Microsoft Copilot and is not responsible for their availability, security, privacy practices, output, account decisions, feature changes, file limits or service interruptions. A third-party platform may change after purchase. Nothing in this section limits any non-excludable right if the MayneAI product itself fails to meet an applicable consumer guarantee.

Delivery

After successful payment, your download contains the matching platform ZIP and Word guide bundled together in one purchase ZIP. Extract the purchase ZIP to access both files, then follow the Word guide and the onboarding instructions inside the platform ZIP. If the files do not arrive or cannot be downloaded, contact mayneai@mayneai.com.au.

You are responsible for downloading and securely retaining your files within the available access limit. Contact us if a genuine delivery problem prevents access.

Licence and permitted use

Your purchase gives you a non-exclusive, non-transferable licence to use and adapt the pack internally for your own business. You may edit your business profile and use the drafts and records created from your own inputs.

You must not resell, sublicense, publish, share or redistribute the pack or its source files as a standalone product or template library. Licence notices and attributions included with the pack must remain with any permitted internal copy. Rights provided under included third-party open-source licences are not restricted by these terms.

Customer content and data

You confirm that you have the rights and permissions needed for any text, data, images, records or other material you submit to a third-party AI platform. Do not submit confidential, personal or sensitive information unless you are authorised to do so and have assessed the platform's privacy and security settings for that use. Under the standard self-service product, MayneAI does not receive or store the content you submit to your chosen AI platform.

Price and payment

Prices are shown in Australian dollars and include GST where applicable. Full payment is required before the download is released. The price shown at checkout is the price charged for that order.

Support and updates

Installation troubleshooting is included under our additional 14-day installation promise. Contact us within 14 days of purchase; if we cannot get your pack installed as described on the advertised platform, we will give you a full refund. See our Refund policy for details. This voluntary promise does not limit your rights under Australian Consumer Law.

The purchase includes the supplied written instructions. Bespoke setup, integrations, ongoing support and future updates are not included unless a separate written offer says otherwise. Support does not include reviewing your business decisions, approving outputs or accepting responsibility for your use of them.

Refunds and consumer rights

Change-of-mind refunds are not offered after download. This does not limit any right or remedy that cannot be excluded under the Australian Consumer Law. Read the Return and refund policy shown at checkout or contact mayneai@mayneai.com.au if there is a problem.

Responsibility for loss

To the extent permitted by law, MayneAI is not responsible for loss or damage to the extent it is caused by:

• your inaccurate, incomplete, unlawful or unauthorised inputs;
• your failure to review, correct or obtain appropriate approval for an output;
• use of the product outside its description or contrary to the supplied instructions;
• your breach of these terms or applicable law;
• a decision, communication or action taken by you or another person using an output; or
• the operation, output, outage, security or change of a third-party AI platform or other service MayneAI does not control.

This allocation does not apply to the extent the loss was caused by MayneAI's breach of a non-excludable obligation.

Limitation of liability

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

For liability that can lawfully be limited and is not caused by MayneAI's negligence, fraud, wilful misconduct or breach of a non-excludable obligation, MayneAI's aggregate liability arising from a product is limited to the amount you paid for that product. This limitation is intended to operate only to the maximum extent permitted by law and in a way that is reasonably necessary to protect MayneAI's legitimate interests in supplying a low-cost self-service digital product.

Problems and disputes

If you believe there is a problem, contact mayneai@mayneai.com.au with the order details and a clear description of the issue. Both parties should first try in good faith to resolve the matter directly. This does not prevent either party from exercising a right or remedy available under law.

Changes to these terms

These terms may be updated for future purchases. The terms presented when you place your order apply to that purchase unless the law requires otherwise.

If part of these terms is invalid or unenforceable, it is to be read down to the minimum extent necessary or severed, and the remaining terms continue to apply.

Governing law

These terms are governed by the laws of Queensland, Australia. Nothing in these terms excludes any law or right that cannot lawfully be excluded.
